LIMITED WARRANTY ON SERIAL 1 PRODUCTS – US

This limited warranty gives you specific legal rights. You may also have other rights, which vary depending on your location.

Serial 1 warrants that during the Warranty Period, the Product will be free from defects in materials and workmanship.

Serial 1 limits the duration and remedies of all implied warranties, including without limitation the warranties of merchantability and fitness for a particular purpose to the duration of this express limited warranty. Some jurisdictions do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

Serial 1's responsibility for defective goods is limited to repair or replacement as described below in this warranty statement.

1. Who does this Warranty apply to?

Serial 1 Cycle Company, LLC ("we" or "Serial 1"), located at 3451 North Triumph Boulevard, Suite 100, Lehi, Utah 84043, USA, extends this limited warranty only to (a) the consumer who originally purchased the Product, and/or (b) any person to whom the Product is transferred during the applicable Warranty Period, but only if such person has a copy of the original proof of purchase received by the consumer who originally purchased the Product ("you").

2. Where is this Warranty valid?

This limited warranty is valid for Products purchased and used in the contiguous United States of America, Hawaii, and Alaska..

3. What does this Warranty cover?

This limited warranty covers defects in materials and workmanship of Serial 1 eBicycles and Serial 1 eBicycle replacement parts (each, a "Product") purchased from Serial 1 or an authorized retailer for the Warranty Period as defined in Section 5 below. For the avoidance of doubt, Product packaging is not subject to this limited warranty.

4. What does this Warranty not cover?

This limited warranty does not cover any damage due to: (a) abuse, neglect, or intentional damage; (b) transportation (after the initial delivery of the Product by Serial 1); (c) storage; (d) improper use; (e) failure to follow the Product instructions or failure to perform any preventive maintenance; (f) modifications; (g) unauthorized repair; (h) installation of parts other than Serial 1 parts or their equivalent (as approved by Serial 1); (i) corrosion and normal wear and tear; or (i) external causes such as accidents, abuse, or other actions or events beyond our reasonable control.

5. What is the Warranty Period?

This limited warranty starts on the date of your purchase or date of delivery (whichever is later) and lasts for the period set forth below (the "Warranty Period"). THE WARRANTY PERIOD IS NOT EXTENDED IF WE REPAIR OR REPLACE THE PRODUCT. We may change the availability of this limited warranty at our discretion, but any changes will not be retroactive.

6. What are your remedies under this Warranty?

With respect to any defective Product during the Warranty Period, we will, in our sole discretion, either repair or replace such Product (or the defective part) free of charge. We will also pay for reasonable shipping and handling fees to return the repaired or replacement Product to you.

7. How do you obtain Warranty service?

To make a claim under this warranty, you must, within the applicable Warranty Period, initiate a warranty claim by visiting be serial1.com/warranty-claims/ and filling out and submitting our Warranty Request Form. If you have warranty service questions, or if you would like help with completing a Warranty Request Form, please contact us at +1-844-737-4251 or Support@Serial1.com for assistance.

When you fill out and submit a Warranty Request Form, we may ask you to provide certain information about yourself and your Product, including but not limited to the following:

  • First and last name
  • Email address
  • Phone number
  • Physical mailing address
  • Product serial number from eBicycle
  • Original invoice, receipt and/or other proof of purchase, or an image or scan of the same
  • Detailed description of defect or problem
  • Images or video of the defect or problem

After you submit the Warranty Request Form, we will review your claim and contact you via phone or email to provide additional instructions. We may also ask you for additional information about your claim.

8. Limitation of Liability

The remedies described above are your sole and exclusive remedies and our entire liability for any breach of this limited warranty. Our liability shall under no circumstances exceed the actual amount paid by you for the defective Product, nor shall we under any circumstances be liable for any consequential, incidental, special or punitive damages or losses, whether direct or indirect.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.


LIMITED WARRANTY ON SERIAL 1 PRODUCTS – CA

This limited warranty gives you specific legal rights. You may also have other rights, which vary depending on your jurisdiction of residence.

Serial 1 warrants that during the Warranty Period (as defined in Section 5 below‎), the Product (as defined in Section 3 below) that you purchased in Canada directly from Serial 1 or an authorized retailer will be free from defects in materials and workmanship under normal household use in accordance with published ‎instructions.

This warranty is in lieu of all other warranties and conditions, and ‎‎there ‎are no other warranties, conditions, representations or ‎‎guarantees of ‎any kind, either statutory, express or implied by law or ‎‎custom, regarding the ‎product, including without limitation those ‎‎regarding merchantability, ‎fitness for purpose, correspondence to ‎‎sample, condition or quality. ‎ Some jurisdictions do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. 

1. LIMITATION OF LIABILITY

Customers in Quebec: Quebec's Consumer Protection Act (CQLR c P-40.1) provides you ‎with certain rights, including warranties as to acceptable quality, safety, durability, ‎accurate description and against hidden defects. Nothing in this provision is intended to ‎limit or replace any of your rights under the Consumer Protection Act (CQLR c P-40.1), and ‎to the extent that it is prohibited by law, the exclusion hereunder does not apply to Quebec ‎residents.

IN ALL OTHER JURISDICTIONS, AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE REMEDIES DESCRIBED IN THIS LIMITED WARRANTY STATEMENT ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. SERIAL 1'S LIABILITY WILL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE COVERED PRODUCTS, NOR WILL SERIAL 1 UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT. SERIAL 1 LIMITS ALL EXPRESS AND IMPLIED WARRANTIES TO THE

FULLEST EXTENT PERMITTED BY LAW, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY. 

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EXCEPT AS SET OUT IN THIS LIMITED WARRANTY, WE WILL NOT BE LIABLE TO YOU FOR ANY LIABILITY OR ‎DAMAGE (INCLUDING ‎WITHOUT LIMITATION FOR PERSONAL INJURY OR DEATH), HOWEVER CAUSED AND ON ‎ANY THEORY OF LIABILITY (WHETHER IN ‎CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE)) ‎ARISING FROM OR RELATED YOUR POSSESSION OR USE OF THE ‎PRODUCT, EVEN IF WE KNEW OR OUGHT ‎TO HAVE KNOWN OF THE POSSIBILITY OF SUCH LIABILITY OR DAMAGE.‎ 

SOME JURISDICTIONS, INCLUDING QUEBEC, DO NOT ALLOW EXCLUSIONS OR LIMITATIONS OF IMPLIED OR LEGAL WARRANTIES OR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE EXCLUSION OR LIMITATION MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. FEDERAL, PROVINCIAL AND LOCAL LAWS MAY GRANT YOU OTHER RIGHTS THAT ARE NOT AFFECTED OR REDUCED BY THIS WARRANTY.

TO THE EXTENT PERMITTED UNDER APPLICABLE LAW, ‎SERIAL 1'S RESPONSIBILITY FOR DEFECTIVE GOODS IS LIMITED TO REPAIR OR REPLACEMENT AS DESCRIBED BELOW IN THIS LIMITED WARRANTY STATEMENT.

EXCEPT TO THE EXTENT REQUIRED UNDER APPLICABLE LAW, INCLUDING IN QUEBEC ‎WHERE THE WARRANTY IS REQUIRED TO BE EXTENDED FOR A PERIOD EQUAL TO ‎THE TIME DURING WHICH THE MERCHANT OR THE MANUFACTURER HAS THE GOODS ‎OR PART OF THE GOODS IN THEIR POSSESSION FOR THE PERFORMANCE OF THIS ‎WARRANTY OR PURSUANT TO THE RECALL OF THE GOODS OR PART OF THE GOODS ‎BY THE MANUFACTURER, ‎THE WARRANTY PERIOD IS NOT EXTENDED IF WE REPAIR OR REPLACE THE PRODUCT. WHERE APPLICABLE LAW REQUIRES AN EXTENSION OF THE WARRANTY PERIOD, ‎THE EXTENSION WILL BE LIMITED TO THE MINIMAL AMOUNT OF TIME REQUIRED ‎UNDER APPLICABLE LAW.  ‎We may change the availability of this limited warranty at our discretion, but any changes will not be retroactive.
